Terms of Service
Welcome to dfwagentops.com (the "Site"), operated by DFW AgentOps ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Site, including any content, features, forms, booking widgets, newsletter subscriptions, and information you read or submit here.
Please read these Terms carefully. By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
These Terms are written in plain English on purpose. If anything here is unclear, email [email protected] and we will explain it.
1. Who We Are
DFW AgentOps is a Dallas-Fort Worth based AI agent setup and managed operations service for small businesses. We help non-technical business owners deploy, run, and maintain AI-powered automations — chatbots, document processing, scheduling agents, reporting dashboards, workflow orchestration, and similar tools.
- Owner: Gavin Walsh
- Email: [email protected] / [email protected]
- Entity type: Sole proprietor
Nothing on this Site creates an employer-employee, partnership, joint-venture, agency, or fiduciary relationship between you and DFW AgentOps.
2. What the Site Is (and Isn't)
The Site is a marketing and information resource. You can:
- Read about our service tiers, pricing, and approach.
- Book a free introductory call through our Cal.com widget.
- Contact us through forms or the direct email addresses listed above.
- Subscribe to updates or newsletters if we offer them.
- Download or view content we publish (articles, case studies, guides).
The Site is not a product. It does not run AI agents for you, process your business data, or deliver paid services. Paid services are delivered only after you sign a written Master Services Agreement (MSA) and a Statement of Work (SOW) with us. Until both documents are signed, nothing you read on the Site, say on a discovery call, or receive in an email proposal is a binding commitment by DFW AgentOps to perform any work.
3. Not Professional Advice
Content on the Site — including blog posts, service descriptions, case studies, automation examples, pricing estimates, and ROI projections — is general information, not professional advice. Specifically:
- We do not provide legal advice. Nothing on this Site is a substitute for a licensed Texas attorney.
- We do not provide medical advice. Nothing on this Site is a substitute for a licensed healthcare provider.
- We do not provide accounting, tax, or financial advice. Nothing on this Site is a substitute for a licensed CPA or financial advisor.
- We do not provide investment advice. Any reference to market tools, trading research, or prediction markets is illustrative only and is not a recommendation to buy, sell, or hold any asset.
If your business is in a regulated industry (healthcare, legal, finance, insurance), you should consult a qualified professional before acting on anything you read here.
4. AI Content Disclaimer — Important
Parts of the Site, including some written content, service descriptions, pricing estimators, and interactive tools, may be generated or assisted by artificial intelligence and large language models (including Anthropic Claude, OpenAI GPT, Google Gemini, and local open-source models).
AI output can be wrong. It can contain factual errors, outdated information, invented citations, incorrect pricing, and confident-sounding mistakes. We review AI-assisted content before publishing, but we do not guarantee it is error-free. You must independently verify any information on this Site before relying on it to make a business decision.
Any paid engagement you enter into with DFW AgentOps will include a separate, more detailed AI disclaimer as part of the MSA and AI Addendum. That disclaimer includes a human-in-the-loop requirement: you (the client) are responsible for reviewing AI outputs before acting on them, and we are not liable for actions you take based on un-reviewed AI output.
5. Acceptable Use
You agree not to use the Site in any way that:
- Violates any applicable federal, state, or local law (including Texas law).
- Harasses, threatens, defames, or impersonates any person.
- Attempts to gain unauthorized access to the Site, its servers, or any connected systems.
- Scrapes, crawls, or harvests content at a volume that interferes with normal operation. Reasonable indexing by search engines is allowed.
- Uses the Site's content to train a competing AI model or service without our written permission.
- Submits false, misleading, or malicious information through any form, booking widget, or contact channel.
- Uploads or transmits any virus, malware, or harmful code.
- Uses the Site to send unsolicited commercial email ("spam") to our address or any address listed here.
We may suspend or terminate access for any visitor who violates this section, at our sole discretion and without notice.
6. Booking a Call
The Site integrates with Cal.com to let you book a free introductory call. When you book, Cal.com processes your name, email, any notes you provide, and the calendar slot. Cal.com's own terms and privacy policy apply to that interaction. We use the booking information only to prepare for and hold the call.
Booking a call does not create a paid engagement. It is an exploratory conversation. No fees apply, and either of us can decline to move forward for any reason.
7. Intellectual Property
All content on the Site — text, graphics, logos, code, layouts, and the "DFW AgentOps" name and marks — is owned by DFW AgentOps or licensed to us, and is protected by U.S. and Texas intellectual property law.
You may:
- View, print, or share individual pages for personal or internal business reference.
- Quote short excerpts with attribution (e.g., "Source: DFW AgentOps, dfwagentops.com").
You may not:
- Republish or redistribute substantial portions of the Site without written permission.
- Remove copyright notices or branding.
- Use the DFW AgentOps name or logo to imply endorsement of your own products or services.
Any feedback or suggestions you send us about the Site or our services becomes ours to use without compensation, credit, or restriction.
8. Third-Party Links and Services
The Site may link to third-party websites, tools, or services (Cal.com, model providers like Anthropic/OpenAI/Google, payment processors, analytics, hosting providers, chambers of commerce, industry associations). We do not control those third parties and are not responsible for their content, terms, privacy practices, or availability. Your use of any linked service is governed by that service's own terms.
9. Privacy
Information you submit through the Site is handled under our Privacy Policy, which is incorporated into these Terms by reference. In summary:
- We collect only what you give us or what the Site needs to function (basic analytics, form submissions, booking data).
- We do not sell your personal information.
- We do not use visitor data from the Site to train AI models.
- We comply with applicable Texas privacy law, including the Texas Business and Commerce Code Chapter 521 breach-notification requirements and, where it applies to us or our clients, the Texas Data Privacy and Security Act (TDPSA).
If you have a privacy question, email [email protected].
10. Disclaimers and Limitation of Liability
The Site is provided "as is" and "as available." To the fullest extent allowed by Texas law, DFW AgentOps disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, and continuous availability.
We do not warrant that:
- The Site will be uninterrupted, timely, secure, or error-free.
- Content on the Site is accurate, complete, or current.
- AI-generated or AI-assisted content is free of errors.
- Any result, ROI figure, timeline, or cost estimate shown on the Site will apply to your business.
Limitation of Liability. To the fullest extent allowed by Texas law, DFW AgentOps and its owner, Gavin Walsh, will not be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages — including lost profits, lost revenue, lost data, or business interruption — arising out of or related to your use of the Site, even if we have been advised of the possibility of such damages.
Total cap. Our total cumulative liability to you for any claim arising out of or related to the Site and these Terms is limited to $100 USD. This cap does not apply to claims of gross negligence, willful misconduct, fraud, or infringement of our intellectual property.
If you have entered into a paid engagement with us, the MSA you signed — not these website Terms — governs liability for that paid work. The MSA liability cap is separate and typically much higher (12 months of fees paid or $25,000, whichever is greater).
11. Indemnification
You agree to defend, indemnify, and hold harmless DFW AgentOps and Gavin Walsh from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising out of:
- Your violation of these Terms.
- Your misuse of the Site.
- Your violation of any law or the rights of a third party.
- Any business decision you make based on Site content without independent verification.
12. Governing Law and Venue
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Federal law applies where it preempts Texas law.
Any dispute arising out of or related to these Terms or the Site that cannot be resolved informally will be brought exclusively in the state or federal courts located in Dallas County, Texas, and you consent to personal jurisdiction and venue in those courts.
Informal resolution first. Before filing any legal action, you agree to contact us at [email protected] with a written description of the dispute. We will attempt to resolve the issue in good faith within 30 days. If we cannot, either party may proceed to court.
Small claims. Either party may bring a qualifying dispute in a Texas Justice Court (small claims) without following the informal resolution step above.
13. Changes to These Terms
We may update these Terms from time to time. When we do, we will change the "Last updated" date at the top and, for material changes, post a notice on the Site homepage for at least 14 days. Continued use of the Site after an update means you accept the new Terms. If you do not accept the new Terms, stop using the Site.
14. Termination
We may suspend or terminate your access to the Site at any time, for any reason, without notice — including for violations of Section 5 (Acceptable Use). Sections that by their nature should survive (IP, disclaimers, limitation of liability, indemnification, governing law) survive any termination.
15. Miscellaneous
- Entire agreement. These Terms and our Privacy Policy are the entire agreement between you and DFW AgentOps regarding the Site. They replace any earlier agreements on the same topic.
- Severability. If any part of these Terms is held unenforceable, the rest remains in effect.
- No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
- Assignment. You may not assign these Terms. We may assign them to a successor in connection with a merger, sale, or reorganization.
- Notices to us. Email [email protected].
- Headings. Section headings are for convenience only and do not affect interpretation.
- Force majeure. We are not liable for delays or failures in Site availability caused by events beyond our reasonable control (outages, natural disasters, cyberattacks, internet failures, power loss, acts of government).
